By accessing or using color.micru.org or any other utilities provided by Micru (including all subdomains at micru.org), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with all of these terms, you must immediately cease use of our services. These terms constitute a legally binding agreement between you and Micru.

Micru provides various web-based micro utilities, tools, and converters for developers and digital professionals. Color.micru.org specifically provides color conversion, palette generation, contrast checking, and image color extraction tools. These services are provided on a static, as-is basis through our website(s). We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We also reserve the right to refuse service to anyone for any reason at any time.

3. Intellectual Property Rights

The content, features, and functionality of Micru websites, including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement of the content, are owned by Micru or its licensors and are protected by copyright, trademark, and other intellectual property laws. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. WHILE WE STRIVE FOR MATHEMATICAL ACCURACY IN ALL COLOR CONVERSIONS AND CALCULATIONS, YOU ARE RESPONSIBLE FOR VERIFYING CRITICAL COLOR VALUES INDEPENDENTLY, PARTICULARLY FOR ACCESSIBILITY COMPLIANCE PURPOSES SUCH AS WCAG CONTRAST REQUIREMENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MICRU, ITS OWNERS, OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OUR SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OUR SERVICES; (III) ANY CONTENT OBTAINED FROM OUR SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL MICRU'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, OR LOSSES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

7. Indemnification

You agree to defend, indemnify, and hold harmless Micru, its owners, operators, contributors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the services, by you or any person using your account and password; b) a breach of these terms; or c) Content posted on the services.

8. Privacy and Data Collection

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our collection and use of information as described in our Privacy Policy.

15. Waiver

Any failure by Micru to enforce any provision of these Terms will not be considered a waiver of our right to enforce such provision. No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure by Micru to assert a right or provision under these Terms will not constitute a waiver of such right or provision.
